    The client agrees to pay the indemnified entities, promptly and for any and all claims, losses, damages, costs, and expenses, including attorney’s fees, incurred by the any of the indemnified entities in the enforcement of any of the provisions of the agreement, or any other contracts between company and client.

    Termination

    MobilityVisa reserves the right to immediately terminate your access and use of the site, or any services, in the event of any conduct by you or through your account which MobilityVisa, in its sole discretion, considers being unacceptable, or in the event of any breach by you of the terms and conditions. Without limiting the foregoing, accounts that generate excessive spam will be terminated immediately. Excessive spam is considered to be a constant flood of spam messages which may cause a lag or damage to. Also, accounts that become delinquent (overdue payments by 14-days) will be terminated. Upon termination, you agree to cease all use of this site and MobilityVisa services.

    By agreeing to these Terms and Conditions, you hereby consent to MobilityVisa privacy provisions. 

    1. Upon registration, you acknowledge your consent to share certain private information which we use for the purpose of confirming your identity and ensuring the security of your deposits. This information is collected in line with our stringent verification procedures used to deter money laundering operations and ensure legality.
    2. You undertake to supply us with true, updated and accurate information concerning identity.
    3. Our data collection procedures include the collection of client’s freely disclosed information and we may do independent research and use cookies for the purposes of gathering data about the manner in which you interact with us on our website. The collection of information may also be used to be able to supply you with suggested additional products.
    4.     Storage Period

    We do not store the personal data for longer than is legally permitted and necessary for the related processing purposes. The storage period depends on the type of personal data, the purposes, and the applicable law and therefore varies per use.

    Typically, we store User’s personal data for as long as the User is using our Services or for as long as we have another purpose to do so and, thereafter, for no longer than is required or permitted by law or necessary for internal reporting and reconciliation purposes. 

    We erase personal data after the above-described storage period or when the User requests us to erase his/her personal data.

When on a secure webpage, such as the payment reply form, the lock icon on the bottom of Web browsers such as Microsoft Internet Explorer becomes locked. Additionally, the Website operates by the official PCI security standards. While we have taken significant measures to ensure the security of information submitted by using the Offered Services, Products and Software, MobilityVisa and the Website cannot guarantee the security of information collected during your use of the Offered Services, Products and Software and shall not be liable in any way if your data is compromised.

    Paid Services

    Fees & Changes

    MobilityVisa  processes cases at an hour rate of $400USD. A monthly report is being issued to the client, whereas a full disclosure of time dedicated to the case is disclosed. All of our agreements are lump-sum as we are committed to a full comprehensive support throughout the whole process.

    MobilityVisa has the right at any time and for any reason to update, modify or discontinue any feature or aspect of Skilled Talent’s Websites, Offered Services, Products and/or Software, including but not limited to its availability, pricing, content or functionality.

    At its sole discretion, and without derogating from the above said, MobilityVisa reserves the right to add additional features or functions, or subtract or change such or to provide programming updates, upgrades or fixes, MobilityVisa’s Website, Offered Services, Products and/or Software. You agree and acknowledge that MobilityVisa has no obligation to make available to you any previous or subsequent versions of any of MobilityVisa’s Website, Offered Services, Products and/or Software.

    Paid Products

    You acknowledge and agree that MobilityVisa is a private company and that any fee you pay is in return for the handling, storage, optimizing, validating and processing of your information and documents, and are designed to cover MobilityVisa costs and time. Payment of all fees and charges to MobilityVisa, if applicable, must be made by a valid credit or charge card and/or other forms of accepted payment as designated on the websites (hereinafter “Paid Services”). Such Paid Services are specified at MobilityVisa’s websites.

    You acknowledge that SolidVisa may, at its sole discretion and without prior notice, condition the use (of all users or a group of users or your use specifically) of any part or all the of its websites or Offered Products, to include payments, to exclude payments, change or modify such Paid Services, turn unpaid Services or websites (or any part thereof) into Paid Services, and vice versa. Any and all terms and condition of the Terms of Use, including without limitation, any limitations or disclaimers of liability or of warranty, shall apply to the Paid Services, except if explicitly stated to the contrary in the Terms and Conditions brought to your attention prior to such payments. 

    Subject to the terms and conditions of the Terms of Use including, without limitation, the payment of the fee, a user can use the Software to check its eligibility to the various immigration options suggested to Canada. The offered products and/or Software may be used only for its intended purpose, and may not be used to prepare immigration forms, supporting documents or letters on a professional basis.

     

    • If any problem regarding any subject occurs, including financial reimbursement, please do not hesitate to contact Mobility Visa’s customer service department. In case of solving the problem unilaterally by the customer through cancellation of transaction by the bank, Mobility Visa reserves the right to contact the bank and submit a re-presentment letter in order to claim for the funds back. Mobility Visa may, at its sole discretion, cease to provide the offered products and/or Software to certain users or to users paying with certain credit cards.
    • Mobility Visa reserves the right to perform credit checks on all users with third party credit agencies, on the basis of the information provided to us on application or by you in any other manner.
    • Mobility Visa reserves the right to use a third-party electronic payment processors and/or financial institutions to process payments made by you in connection with your use of the offered products and/or Software.
    • In any case of suspected or fraudulent payment, including use of stolen credit cards, or any other fraudulent activity (including any charge-back or other reversal of a payment), Mobility Visa reserves the right to block a user’s account and reverse any refund made, if any. Mobility Visa shall be entitled to inform any relevant authorities or entities (including credit reference agencies) of any payment fraud or otherwise unlawful activity, and may employ collection services to recover payments.
    • Any communication or material you post or transmit by or on any of Mobility Visa’s websites or through the use of the offered products and/or Software shall be treated as non-confidential and non-proprietary. You assume full responsibility for anything you post or transmit. If you object to your information being transferred or used in this way please do not use any of Mobility Visa’s websites’ or offered products.

    Refund Policy

    Fees & Refund Policy

    • We are a private company. The fee you pay will be applied toward covering our costs and time involved. Should you choose to pay our fee by credit card, your card will be charged immediately upon purchase, even if we do not commence work at such time.
    • We do not guarantee any outcome and no refund shall be made in case intended outcome is not reached. We treat all of our client’s cases with the utmost seriousness and will do our best to ensure that the case is successful. It should be understood that our clients are paying us for our expertise and for our work and time on a case, and while we will always endeavor to achieve a positive result, we do not guarantee the success of any matter that we are retained for, and do not issue refunds because a case was unsuccessful.
    • Refund may be requested by approaching us by either phone or email. Our management will consider your case and thereafter make their decision. We endeavor to respond to all inquiries within 5 business days. Registration fees are not refundable if you have already submitted, or commenced submission or filling process, of at least one application, including in the case where an application was not submitted because it was lacking any information. In the event a refund is considered, MobilityVisa may at its sole discretion agree to refund fees paid subject to a deduction for the time so far spent on the case.
    • Any refunds shall be paid using only and exclusively the same payment method with which you made your payments to MobilityVisa.
    • Customers who purchased one of our products or services over the phone, is entitled, in case of a dispute, to have a full refund within 14 days from the date of purchase.

    Bill Delivery

    • The purchase of MobilityVisa service packages can be processed via the accepted payment method. The price set out on the site is binding. It is your sole responsibility to contact MobilityVisa directly if you don’t receive your credit card statement. At the time of purchase, you will be notified via checkout or MobilityVisa may send an e-mail notification to the e-mail address listed in your account. It is your sole responsibility to ensure that this information is accurate. 

      Note that in your credit card statement the payment will appear as MobilityVisa.

    Cancellation

    We guarantee to give clients the confirmation email within 24 – 48 hours, so applications will be processed as soon as the full payment completed. If for any reason you wish to cancel a service before your assessment/immigration file has started or your product order already, you can do so without any penalties or charges, just using Cancel/Delete email to us in your account when logged in or by email to support@MobilityVisa.com You will receive a full refund of any fees paid for this particular service and for return shipping (if prepaid). However, no refund will be given after your order has sent, or our consultants started to review and work on your request.

    5. Mobility Visa is not a government agency and is not affiliated with nor endorsed by the Canadian government agency. As a matter of fact, anyone can apply for Canadian immigration or visa through the official website for Immigration, Refugees and Citizenship Canada (IRCC). However, Mobility Visa offers creative and innovative of solutions that may help you achieving your immigration goals, these solutions are not provided by the Canadian Government.     6. No guarantee of Visa Acceptance

The grant of such access to the Mobility Visa websites and/or servers does not establish consultant-client or attorney-client relationship between you and the authorized representatives.

The authorized representatives, under agreement with Mobility Visa, may assess the qualifications of the user for a Canadian immigration visa. Such assessments are performed on the server-end and are done on an as-is basis. These preliminary eligibility assessments do not constitute a personal immigration advice and do not guarantee the issuance of immigration visa or another document to you.

    Qualified users/clients who are seeking services which fall within the scope of Section A91 of the Immigration and Refugees Protection Act of Canada will be required to sign a personal client retainer agreement with an authorized representative.

    Working Holiday Visa Australia

    Working Holiday Visa (Subclass 417)

    The Subclass 417 visa allows certain tourists aged between 18 and 30 years old (inclusive) – and Canadian, British French and Irish citizens 18 to 35 years old (inclusive) to have an extended holiday in Australia, while supplementing their funds with short-term work. The visa is valid for 12 months and allows multiple entries into and exits from Australia. Visa holders can generally work for up to six months with any one employer and can study for up to four months. Work up to 12 months for some types of specified work and regional areas may be possible.

    A second Working Holiday visa may be granted to those applicants who complete three months of specified work in regional Australia while holding their first Working Holiday visa. From 1 July 2019, a third Working Holiday visa may be granted where the visa holder meets additional specified work requirements.

    Requirements

    These are the minimum requirements for an application for this type of visa. Depending upon your particular circumstances, you may need to meet additional requirements.

    The Specified Work requirement for a Second or Third Visa

    For the purpose of a second or third Working Holiday visa, ‘specified work’ includes certain types of paid work carried out in the following industries:

    • plant and animal cultivation
    • fishing and pearling
    • tree farming and felling
    • mining; and
    • construction

    Voluntary work is not accepted as ‘work’ for the purposes of applying for a second or third Working Holiday visa.

    The period of specified work (either three months for a second Working Holiday visa, or six months for a third Working Holiday visa) means an evidenced period of paid, full-time equivalent work over a minimum period of 88 calendar days (for three months) or 176 calendar days (for six months) in regional Australia. ‘Regional Australia’ is defined by post code. One day of full-time work is taken to be the normal number of hours per day (or shift) that is considered standard for that particular industry and the role in which you are employed. You can complete the work in a variety of ways.

    For example, to be eligible for a second Working Holiday visa, an applicant must evidence:

    • working full time, 5 days per week for a continuous 3 calendar month period, including on a piecework rate agreement OR
    • working less than 5 days per week in any combination of full-time, part-time or piecework rate work which adds up to the equivalent of five days a week over 3 calendar months OR
    • working less than five days a week over a longer period than 3 calendar months, including on a piece work rate agreement.

    The work can be with one employer, or several, and can be spread over the period of your stay in Australia. You can also work longer than the required period in regional Australia in specified work. Paid public holiday leave and sick days are counted as a day of specified work. Unpaid leave or holidays, and unpaid days due to severe or seasonal weather, are not counted.

    Application Process

    The visa application is lodged with the Department of Home Affairs (the ‘DOHA’), along with any supporting documents. The main criterion is that you satisfy the requirements listed above. You must also have access to sufficient funds to support yourself during the initial stages of your holiday. In addition, you must meet certain health and character requirements, and may be asked to provide evidence of health and/or travel insurance.

    You must enter Australia within 12 months of the date that your visa is granted. You may then work in any job in any location in Australia, provided that you do not work for more than six months for any one employer unless an exemption applies. You must also not study for more than four months.

    Federal Skilled Workers are persons with suitable education, work experience, age and language abilities under one of Canada’s official languages and who are selected under the Express Entry Immigration system to apply for permanent residence.
